THE full extent of legal building works across Didim has been revealed by Mayor Deniz Atabay.

Over the past three years, 2,143 plans for construction have been passed by the local authority, but only 1,855 have been acted on.

In 2015, 758 construction permits were granted, with 682 buildings erected;

In 2016, 704 permits were passed, with only 432 buildings erected;

In 2017, 681 plans were passed, but 741 properties were built. These builds were probably from permits given in previous years.

DIDIM’S new tennis organisation, based at the Aquasis Hotel, has announced plans for two tournaments in May.

The Didim Tennis Academy, with the backing of Didim Council, has unveiled its plans for two cup events.

The first big organization will be organized for the 6-7-8-9 age group between May 3-6 2018. The development camp will last 4 days and the sportsmen will be given training by the national team. Close to 400 athletes and their families are expected to attend.

And a further 100 tennis players will be flooding into Didim for the Didim Cup between May 11-13 2018. Categories for the over 30s will include single ladies, single men, beginners ladies and men.

PART ONE

General Provisions

CHAPTER ONE
Purpose, Scope, Definitions and Principles

Purpose
ARTICLE 1
– The purpose of this law is to ensure that animals are afforded a comfortable life and receive good and proper treatment, to protect them in the best manner possible from the infliction of pain, suffering and torture, and to prevent all types of cruel treatment.

Scope
ARTICLE 2 – This Law includes the regulations to be made in line with the purpose article, the precautions to be taken, the coordination, supervision, restrictions and obligations to be imposed and the penal provisions to be enforced.

Definitions
ARTICLE 3 –  In this Act, the terms;
a) Habitat: means the natural home of an animal or a group of animals,

b) Ethology: means the branch of science which studies the naturally occurring behaviour of animals according to their species,

c) Ecosystem: means the biological, physical and chemical system within which living organisms carry out their relationships with each other and their non-living surroundings,

d) Species: means populations which are capable of mating and interbreeding productively with each other,

e) Domesticated animal: means animals which have been cultivated and trained by humans,

BİRİNCİ KISIM

Genel Hükümler

 

BİRİNCİ BÖLÜM

Amaç, Kapsam, Tanımlar ve İlkeler

 

Amaç

Madde 1 — Bu Kanunun amacı; hayvanların rahat yaşamlarını ve hayvanlara iyi ve uygun muamele edilmesini temin etmek, hayvanların acı, ıstırap ve eziyet çekmelerine karşı en iyi şekilde korunmalarını, her türlü mağduriyetlerinin önlenmesini sağlamaktır.

 

Kapsam

Madde 2 — Bu Kanun, amaç maddesi doğrultusunda yapılacak düzenlemeleri, alınacak önlemleri, sağlanacak eşgüdümü, denetim, sınırlama ve yükümlülükler ile tâbi olunacak cezaî hükümleri kapsar.

 

 

Tanımlar

Madde 3 — Bu Kanunda geçen terimlerden;

 

a)Yaşama ortamı: Bir hayvanın veya hayvan topluluğunun doğal olarak yaşadığı yeri,

b) Etoloji: Bir hayvan türünün doğuştan gelen, kendine özgü davranışlarını inceleyen bilim dalını,

c) Ekosistem: Canlıların kendi aralarında ve cansız çevreleriyle ilişkilerini bir düzen içinde yürüttükleri biyolojik, fiziksel ve kimyasal sistemi,

d) Tür: Birbirleriyle çiftleşebilen ve üreme yeteneğine sahip verimli döller verebilen populasyonları,

e) Evcil hayvan: İnsan tarafından kültüre alınmış ve eğitilmiş hayvanları

 

 

 

f) OWNERLESS animal: means domestic animals which do not have a place to shelter or which are outside the limits of the house or land of their owner or guardian or which are not under the control or direct supervision of any owner or guardian,

g) Incapacitated animal: means an animal used for riding or transportation which for various reasons such as age, maiming, injury or illness, not including contagious and epidemic animal illnesses, has physically lost the ability to work,

h) Wild animal: means vertebrate and invertebrate animals living freely in nature which have not been domesticated or cultivated.

ı) Domestic animals and pets: means all type of animals retained or intended to be retained by people in their houses, workplaces or on their land for private pleasure or security purposes whose care and responsibility is undertaken by their owners,

j) Controlled animal: means duly registered house animals and pets which have been adopted by a person, institution, organisation or legal entity and whose care, vaccinations and periodic health check-ups are carried out.

k) Animal Shelter: means a facility for the rehabilitation of animals,

l) Testing: means the use of an animal for an experimental or other scientific purpose which will cause the animal pain, suffering, misery or long term damage,

m) Test animal: means an animal which is or will be used in testing,

n) Slaughter animal: means animals which are slaughtered for food purposes,

o) Ministry: means the Ministry of the Environment and Forestry,

f) SAHIPSIZ hayvan: Barınacak yeri olmayan veya sahibinin ya da koruyucusunun ev ve arazisinin sınırları dışında bulunan ve herhangi bir sahip veya koruyucunun kontrolü ya da doğrudan denetimi altında bulunmayan evcil hayvanları,

g) Güçten düşmüş hayvan: Bulaşıcı ve salgın hayvan hastalıkları haricinde yaşlanma, sakatlanma, yaralanma ve hastalanma gibi çeşitli nedenlerle fizikî olarak iş yapabilme yeteneğini kaybetmiş binek ve yük hayvanlarını,

h)Yabani hayvan: Doğada serbest yaşayan evcilleştirilmemiş ve kültüre alınmamış omurgalı ve omurgasız hayvanları,

ı) Ev ve süs hayvanı: İnsan tarafından özellikle evde, işyerlerinde ya da arazisinde özel zevk ve refakat amacıyla muhafaza edilen veya edilmesi tasarlanan bakımı ve sorumluluğu sahiplerince üstlenilen her türlü hayvanı,

j) Kontrollü hayvan: Bir kişi, kuruluş, kurum ya da tüzel kişilik tarafından sahiplenilen, bakımı, aşıları, periyodik sağlık kontrolleri yapılan işaretlenmiş kayıt altındaki ev ve süs hayvanlarını,

k) Hayvan bakımevi: Hayvanların rehabilite edileceği bir tesisi,

l) Deney: Herhangi bir hayvanın acı, eziyet, üzüntü veya uzun süreli hasara neden olacak deneysel ya da diğer bilimsel amaçlarla kullanılmasını,

m) Deney hayvanı: Deneyde kullanılan ya da kullanılacak olan hayvanı,

n) Kesim hayvanı: Gıda amaçlı kesimi yapılan hayvanları,

o) Bakanlık: Çevre ve Orman Bakanlığını, İfade eder.

 

 

Principles

ARTICLE 4 – The fundamental principles relating to the protection of animals and their welfare are as follows;

a) All animals are born equal and have a right to life within the framework of the provisions of this Law.

b) Domesticated animals have the freedom to live according to the living conditions specific to their species. The lives of OWNERLESS animals should be supported in the same way as those of animals with owners.

c) The necessary measures must be taken in order to protect, supervise and care for animals and shield them from maltreatment.

d) It is a principle that natural persons and legal entities which meet the conditions set forth in this Law and which look after or wish to look after incapacitated or OWNERLESS animals without consideration of any material gain or benefit but rather acting from a sense of humanitarian and conscientious responsibility will be encouraged and coordination in this regard will be ensured.

e) It is a principle that endangered species and their natural habitats will be protected.

f) It is a principle that wild animals will not be removed from their natural habitats, and animals which are living freely in nature will not be captured and deprived of their freedom.

g) In the protection of animals and the facilitation of their welfare, the hygiene, health and safety of humans and other animals must be taken into account.

h) It is a principle that animals will be cared for, fed, sheltered and transported under the conditions suited to their species.
ı) Those that transport animals or have them transported must do so in a suitable environment and under suitable conditions according to their species and nature, and they must be fed and cared for during transportation.
j) It is a principle that local authorities, in cooperation with voluntary organisations, must establish animal shelters and hospitals for the protection of OWNERLESS and incapacitated animals, provide care and treatment for them and carry out educational programmes.

k) It is a principle that the owners of cats and dogs being fed and accommodated in communal areas are expected to have them sterilised in order to prevent uncontrolled reproduction. Furthermore, those who wish to breed from the said animals must register all young animals born and are responsible for their care and/or distribution. An administrative monetary fine of two hundred and fifty Turkish Lira per animal for those who act in breach of the provision of the second sentence of paragraph (k) of article 4.

İlkeler

Madde 4 — Hayvanların korunmasına ve rahat yaşamalarına ilişkin temel ilkeler şunlardır:

a) Bütün hayvanlar eşit doğar ve bu Kanun hükümleri çerçevesinde yaşama hakkına sahiptir.

b) Evcil hayvanlar, türüne özgü hayat şartları içinde yaşama özgürlüğüne sahiptir. SAHIPSIZ hayvanların da, sahipli hayvanlar gibi yaşamları desteklenmelidir.

 

c) Hayvanların korunması, gözetilmesi, bakımı ve kötü muamelelerden uzak tutulması için gerekli önlemler alınmalıdır.

 

d) Hiçbir maddî kazanç ve menfaat amacı gütmeksizin, sadece insanî ve vicdanî sorumluluklarla, SAHIPSIZ ve güçten düşmüş hayvanlara bakan veya bakmak isteyen ve bu Kanunda öngörülen koşulları taşıyan gerçek ve tüzel kişilerin teşviki ve bu kapsamda eşgüdüm sağlanması esastır.

 

 

e) Nesli yok olma tehlikesi altında bulunan tür ve bunların yaşama ortamlarının korunması esastır.

f) Yabani hayvanların yaşama ortamlarından koparılmaması, doğada serbestçe yaşayan bir hayvanın yakalanıp özgürlükten yoksun bırakılmaması esastır.

g) Hayvanların korunması ve rahat yaşamalarının sağlanmasında; insanlarla diğer hayvanların hijyen, sağlık ve güvenlikleri de dikkate alınmalıdır.

h) Hayvanların türüne özgü şartlarda bakılması, beslenmesi, barındırılma ve taşınması esastır.

ı) Hayvanları taşıyan ve taşıtanlar onları türüne ve özelliğine uygun ortam ve şartlarda taşımalı, taşıma sırasında beslemeli ve bakımını yapmalıdırlar.

 

j) Yerel yönetimlerin, gönüllü kuruluşlarla işbirliği içerisinde, SAHIPSIZ ve güçten düşmüş hayvanların korunması için hayvan bakımevleri ve hastaneler kurarak onların bakımlarını ve tedavilerini sağlamaları ve eğitim çalışmaları yapmaları esastır.

k) Kontrolsüz üremeyi önlemek amacıyla, toplu yaşanan yerlerde beslenen ve barındırılan kedi ve köpeklerin sahiplerince kısırlaştırılması esastır. Bununla birlikte, söz konusu hayvanlarını yavrulatmak isteyenler, doğacak yavruları belediyece kayıt altına aldırarak bakmakla ve/veya dağıtımını yapmakla yükümlüdür.

 

 

PART TWO
Precautionary Measures
CHAPTER ONE
Ownership, care and welfare of animals

Ownership and care of animals
ARTICLE 5 – A person who participates in a general training program regarding the care of animals and who takes ownership of or looks after an animal is liable for sheltering the animal, meeting their ethological needs in accordance with their species and reproductive methods, taking care of their health and taking all necessary precautions with regard to the health and safety of people, animals and the environment.  An administrative monetary fine of fifty Turkish Lira per animal.

Animal owners are obliged to take precautionary measures with regard to environmental pollution caused by their animals or danger and disturbance to other people. They must compensate for any damage caused by their failure to take timely and sufficient precautions.  An administrative monetary fine of fifty Turkish Lira per animal.

Those who sell domestic animals and pets are obliged to take part in certified training programmes arranged by the local authorities in relation to the care and protection of these animals.  An administrative monetary fine of fifty Turkish Lira per animal.

The conditions for owning and keeping domestic pets or controlled animals, the principles and procedures relating to training to be given in animal welfare and the preventative measures against damage and disturbance caused by domestic animals will be determined in a regulation to be issued by the Ministry in coordination with the Ministry of Agriculture and Rural Affairs, having obtained the opinion of the Ministry of Internal Affairs and related organisations.

 

Unless there is a commercial purpose, a domestic pet being cared for within a house or garden cannot be sequestered due to the debts of their owner.

Those who produce and trade in domestic pets are obliged to take precautions in relation to necessary anatomic, physiological and behavioural characteristics in order not to endanger the health of pet owners, the mother selected for reproduction or her young.  An administrative monetary fine of fifty Turkish Lira per animal.

Domestic pets and controlled animals which will not be able to re-establish harmony with their natural environment cannot be abandoned, and cannot be left where they will be unable to feed or adapt to the climate. However, they can be reclaimed or handed over to an animal shelter.  An administrative monetary fine of one hundred and fifty Turkish Lira per animal for those who fail to comply with the bans and obligations in paragraph 7.

 

If the actions in paragraphs one, two and five of article 5, re: failing to comply with the bans and obligations relating to the ownership and care of animals or failing to take the necessary precautions are carried out by a veterinary doctor, a veterinary health technician, an animal welfare volunteer, a member of an animal welfare association or foundation or persons appointed to round up, supervise, care for or protect animals, the fine to be imposed will be doubled.

Hayvanların Sahiplenilmesi, Bakımı ve Korunması

 

Hayvanların sahiplenilmesi ve bakımı

Madde 5 — Bir hayvanı, bakımının gerektirdiği yaygın eğitim programına katılarak sahiplenen veya ona bakan kişi, hayvanı barındırmak, hayvanın türüne ve üreme yöntemine uygun olan etolojik ihtiyaçlarını temin etmek, sağlığına dikkat etmek, insan, hayvan ve çevre sağlığı açısından gerekli tüm önlemleri almakla yükümlüdür.

 

 

 

 

 

Hayvan sahipleri, sahip oldukları hayvanlardan kaynaklanan çevre kirliliğini ve insanlara verilebilecek zarar ve rahatsızlıkları önleyici tedbirleri almakla yükümlü olup; zamanında ve yeterli seviyede tedbir alınmamasından kaynaklanan zararları tazmin etmek zorundadırlar.

Ev ve süs hayvanı satan kişiler, bu hayvanların bakımı ve korunması ile ilgili olarak yerel yönetimler tarafından düzenlenen eğitim programlarına katılarak sertifika almakla yükümlüdürler.

 

Ev ve süs hayvanı ve kontrollü hayvanları bulundurma ve sahiplenme şartları, hayvan bakımı konularında verilecek eğitim ile ilgili usul ve esaslar ile sahiplenilerek bakılan hayvanların çevreye verecekleri zarar ve rahatsızlıkları önleyici tedbirler, Tarım ve Köyişleri Bakanlığı ile eşgüdüm sağlanmak suretiyle, İçişleri Bakanlığı ve ilgili kuruluşların görüşü alınarak Bakanlıkça çıkarılacak yönetmelikle belirlenir.

 

 

 

Ticarî amaç güdülmeden bilhassa ev ve bahçesi içerisinde bakılan ev ve süs hayvanları sahiplerinin borcundan dolayı haczedilemezler.

Ev ve süs hayvanlarının üretimini ve ticaretini yapanlar, hayvanları sahiplenen ve onu üretmek için seçenler annenin ve yavrularının sağlığını tehlikeye atmamak için gerekli anatomik, fizyolojik ve davranış karakteristikleri ile ilgili önlemleri almakla yükümlüdür.

 

 

 

 

Ev ve süs hayvanları ile kontrollü hayvanlardan, doğal yaşama ortamlarına tekrar uyum sağlayamayacak durumda olanlar terk edilemez; beslenemeyeceği ve iklimine uyum sağlayamayacağı ortama bırakılamaz. Ancak, yeniden sahiplendirme yapılabilir ya da hayvan bakımevlerine teslim edilebilir.

 

 

 

 

 

Protection of OWNERLESS and incapacitated animals

 

ARTICLE 6 – It is forbidden to kill OWNERLESS or incapacitated animals, apart from the situations set forth in the Animal Health Police Law no. 3285 (this relates to animals used for experimental or other scientific purposes).  An administrative monetary fine of five hundred Turkish Lira per animal for those who act in breach of the first paragraph of article 6.

Incapacitated animals will not be used for any commercial or performance purposes or used for riding or transporting purposes in any manner.

Within the framework of the legislative provisions in effect regarding the protection, care and supervision of OWNERLESS animals, the arrangements relating to the authority and responsibility of local authorities and measures aimed at eliminating any negative effects on the environment that could occur will be determined in a regulation to be issued by the Ministry in coordination with the Ministry of Agriculture and Rural Affairs, having obtained the opinion of related organisations

OWNERLESS and incapacitated animals must be brought as quickly as possible to animal shelters established or permitted by the local authorities. These animals will first be held in the observation areas established in these centres. It is a principle that animals that have been sterilised, vaccinated and rehabilitated will be registered and released into the environment that they were taken from.

 

The rounding up of OWNERLESS or incapacitated animals and the operating principles and procedures for animal shelters will be determined in a regulation to be issued by the Ministry, having obtained the opinion of related bodies and organisations. Land owned by the Treasury can be allocated with priority to animal shelters and hospitals. The allocation of land that is found to be used for other purposes will be cancelled.

SAHIPSIZ ve güçten düşmüş hayvanların korunması

Madde 6 — SAHIPSIZ ya da güçten düşmüş hayvanların, 3285 sayılı Hayvan Sağlığı Zabıtası Kanununda öngörülen durumlar dışında öldürülmeleri yasaktır.

 

 

 

 

Güçten düşmüş hayvanlar ticarî ve gösteri amaçlı veya herhangi bir şekilde binicilik ve taşımacılık amacıyla çalıştırılamaz.

 

SAHIPSIZ hayvanların korunması, bakılması ve gözetimi için yürürlükteki mevzuat hükümleri çerçevesinde, yerel yönetimler yetki ve sorumluluklarına ilişkin düzenlemeler ile çevreye olabilecek olumsuz etkilerini gidermeye yönelik tedbirler, Tarım ve Köyişleri Bakanlığı ve İçişleri Bakanlığı ile eşgüdüm sağlanarak, diğer ilgili kuruluşların da görüşü alınmak suretiyle Bakanlıkça çıkarılacak yönetmelikle belirlenir.

 

 

SAHIPSIZ veya güçten düşmüş hayvanların en hızlı şekilde yerel yönetimlerce kurulan veya izin verilen hayvan bakımevlerine götürülmesi zorunludur. Bu hayvanların öncelikle söz konusu merkezlerde oluşturulacak müşahede yerlerinde tutulması sağlanır. Müşahede yerlerinde kısırlaştırılan, aşılanan ve rehabilite edilen hayvanların kaydedildikten sonra öncelikle alındıkları ortama bırakılmaları esastır.

SAHIPSIZ veya güçten düşmüş hayvanların toplatılması ve hayvan bakımevlerinin çalışma usul ve esasları, ilgili kurum ve kuruluşların görüşleri alınarak Bakanlıkça çıkarılacak yönetmelikle belirlenir. Hayvan bakımevleri ve hastanelerin kurulması amacıyla Hazineye ait araziler öncelikle tahsis edilir. Amacı dışında kullanıldığı tespit edilen arazilerin tahsisi iptal edilir.

 

 

Land, related buildings and stock may be allocated by municipalities, forestry administrations, the Ministry of Finance or the Privatisation Administration to natural persons and legal entities which meet the conditions set forth in this Law and which look after or wish to look after incapacitated or OWNERLESS animals provided that there is no gain or benefit but rather that they are acting from humanitarian and conscientious goals, and also provided that ownership remains with the state. Suitable facilities can be built on the allocated land with the permission of the related Ministry/Administration.

CHAPTER TWO
Interventions in animals

Surgical Interventions
ARTICLE 7
– Medical and surgical interventions in animals will only be carried out by veterinary doctors.

In order to prevent uncontrolled reproduction, sterilisation interventions will be done without causing the animals pain.An administrative monetary fine of one hundred and fifty Turkish Lira per animal for those who act in breach of the provisions relating to surgical interventions set forth in article 7

Forbidden Interventions
ARTICLE 8
– All types of interventions that will wipe out a species of animal are forbidden.  An administrative monetary fine of seven and a half thousand Turkish Lira per animal for those who act in a manner that could cause the extinction of an animal species as set forth in the first paragraph of article 8

It is forbidden to removed or destroy all or a part of the organs or tissues of an animal as long as they are alive, unless it is for medical reasons.  An administrative monetary fine of one and a half thousand Turkish Lira for those who fail to comply with paragraph two.

Hiçbir kazanç ve menfaat sağlamamak kaydıyla sadece insanî ve vicdanî amaçlarla SAHIPSIZ ve güçten düşmüş hayvanlara bakan veya bakmak isteyen ve bu Kanunda öngörülen şartları taşıyan gerçek ve tüzel kişilere; belediyeler, orman idareleri, Maliye Bakanlığı, Özelleştirme İdaresi Başkanlığı tarafından, mülkiyeti idarelerde kalmak koşuluyla arazi ve buna ait binalar ve demirbaşlar tahsis edilebilir. Tahsis edilen arazilerin üzerinde amaca uygun tesisler ilgili Bakanlığın/İdarenin izni ile yapılır.

 

 

 

İKİNCİ BÖLÜM

Hayvanlara Müdahaleler

 

Cerrahi müdahaleler

Madde 7 — Hayvanlara tıbbî ve cerrahi müdahaleler sadece veteriner hekimler tarafından yapılır.

 

Kontrolsüz üremenin önlenmesi için, hayvanlara acı vermeden kısırlaştırma müdahaleleri yapılır.

 

 

 

 

 

 

Yasak müdahaleler

Madde 8 — Bir hayvan neslini yok edecek her türlü müdahale yasaktır.

 

 

 

 

 

Hayvanların, yaşadıkları sürece, tıbbî amaçlar dışında organ veya dokularının tümü ya da bir bölümü çıkarılıp alınamaz veya tahrip edilemez.

 

 

 

 

 

 

 

 

 

It is forbidden to undertake surgical interventions aimed at altering the external appearance of domestic pets or other non-medical treatments such as cutting tails and ears, removing vocal cords and removing nails or teeth. However permission may be granted for these forbidden interventions where a veterinary doctor deems it necessary to make a non-medical intervention for medical reasons related to veterinary procedures or for the good of a particular animal or in order to prevent reproduction.  An administrative monetary fine of one and a half thousand Turkish Lira for those who fail to comply with paragraph three.

It is forbidden to give an animal hormones or drugs in a manner or dose that will change the nature of his species or ethology, unless it is for medical purposes, to drug an animal with various substances or to artificially alter the behavioural or physical characteristics specific to an animal species.  An administrative monetary fine of one and a half thousand Turkish Lira for those who fail to comply with paragraph four.

Animal Testing
ARTICLE 9
– Animals cannot be used for non-scientific diagnosis, treatment or experiments.

It is a principle that only medical and scientific experiments can be carried out, these will be performed in such a manner as to protect the animals and the animals to be used in these experiments will be cared for and sheltered in a suitable manner.

Where there is no other option, animals can be used for testing in scientific studies.

In organisations and institutions which will carry out animal testing, they will be permitted to do so by ethical committees established or to be established by them.
The establishment of these ethic committees and their operating principles and procedures will be determined in a regulation to be issued by the Ministry having obtained the opinion of the Ministry of Agriculture and Rural Affairs, the Ministry of Health and related organisations.

Ev ve süs hayvanının dış görünüşünü değiştirmeye yönelik veya diğer tedavi edici olmayan kuyruk ve kulak kesilmesi, ses tellerinin alınması ve tırnak ve dişlerinin sökülmesine yönelik cerrahi müdahale yapılması yasaktır. Ancak bu yasaklamalara; bir veteriner hekimin, veteriner hekimliği uygulamaları ile ilgili tıbbî sebepler veya özel bir hayvanın yararı için gerektiğinde tedavi edici olmayan müdahaleyi gerekli görmesi veya üremenin önlenmesi durumlarında izin verilebilir.

 

 

 

Bir hayvana tıbbî amaçlar dışında, onun türüne ve etolojik özelliklerine aykırı hale getirecek şekilde ve dozda hormon ve ilaç vermek, çeşitli maddelerle doping yapmak, hayvanların türlerine has davranış ve fizikî özelliklerini yapay yöntemlerle değiştirmek yasaktır.

 

 

Hayvan deneyleri

Madde 9 — Hayvanlar, bilimsel olmayan teşhis, tedavi ve deneylerde kullanılamazlar.

 

Tıbbî ve bilimsel deneylerin uygulanması ve deneylerin hayvanları koruyacak şekilde yapılması ve deneylerde kullanılacak hayvanların uygun biçimde bakılması ve barındırılması esastır.

 

 

Başkaca bir seçenek olmaması halinde, hayvanlar bilimsel çalışmalarda deney hayvanı olarak kullanılabilir.

Hayvan deneyi yapan kurum ve kuruluşlarda bu deneylerin yapılmasına kendi bünyelerinde kurulmuş ve kurulacak etik kurullar yoluyla izin verilir.

Etik kurulların kuruluşu, çalışma usul ve esasları, Tarım ve Köyişleri Bakanlığı ile Sağlık Bakanlığının ve ilgili kuruluşların görüşleri alınarak Bakanlıkça çıkarılacak yönetmelikle belirlenir.

 

The breeding, feeding, shelter and care of test animals, the registration of enterprises who supply and use these, the qualities of the personnel employed, the records to be kept, which kinds of animals can be bred and the principles to be met by operations feeding, supplying and using test animals will be determined by a regulation to be issued by the Ministry of Agriculture and Rural Affairs.  An administrative monetary fine of two hundred and fifty thousand Turkish Lira per animal for those who fail to comply with article 9 and the issues contained in the regulations issued; an administrative monetary fine of one billion Turkish Lira per animal for those who carry out unauthorised animal testing.

CHAPTER THREE
Trade and Training of Animals

Trade of Animals
ARTICLE 10
– When being sold, the health of animals must be good and their accommodation must be clean and comply with healthy conditions.

The care, feeding and transport of farm animals and arrangements aimed at ensuring their welfare and security during slaughter will be determined by a regulation to be issued by the Ministry of Agriculture and Rural Affairs.

Arrangements relating to the trade of wild animals will be determined in a regulation to be issued by the Ministry.

Those who produce and trade in domestic pets are obliged to take precautions in relation to necessary anatomic, physiological and behavioural characteristics in order not to endanger the health of the mother and her young.

Issues relating to the commercial use of animals in film and advertisements are subject to permission. The principles and procedures relating to this permission will be determined in a regulation to be issued by the Ministry, having obtained the opinion of related organisations.

An animal cannot be used in filming, demonstrations, advertisements or similar work in a manner that would cause it pain, suffering or damage.

 

Deney hayvanlarının yetiştirilmesi, beslenmesi, barındırılması, bakılması, deney hayvanı besleyen, tedarik eden ve kullanıcı işletmelerin tescil edilmesi, çalışan personelin nitelikleri, tutulacak kayıtlar, ne tür hayvanların yetiştirileceği ve deney hayvanı besleyen, tedarik eden ve kullanıcı işletmelerin uyacağı esaslar Tarım ve Köyişleri Bakanlığınca çıkarılacak yönetmelikle belirlenir.

 

 

 

ÜÇÜNCÜ BÖLÜM

Hayvanların Ticareti ve Eğitilmesi

 

Hayvanların ticareti

Madde 10 — Satılırken; hayvanların sağlıklarının iyi, barındırıldıkları yerin temiz ve sağlık şartlarına uygun olması zorunludur.

Çiftlik hayvanlarının bakımı, beslenmesi, nakliyesi ve kesimi esnasında hayvanların refahı ve güvenliğinin sağlanması hususundaki düzenlemeler Tarım ve Köyişleri Bakanlığınca çıkarılacak yönetmelikle belirlenir.

Yabani hayvanların ticaretine ilişkin düzenlemeler Bakanlıkça çıkarılacak yönetmelikle belirlenir.

Ev ve süs hayvanlarının üretimini ve ticaretini yapanlar, annenin ve yavrularının sağlığını tehlikeye atmamak için gerekli anatomik, fizyolojik ve davranış karakteristikleri ile ilgili önlemleri almakla yükümlüdür.

Hayvanların ticarî amaçla film çekimi ve reklam için kullanılması ile ilgili hususlar izne tâbidir. Bu izne ait usul ve esaslar ilgili kuruluşların görüşü alınarak Bakanlıkça çıkarılacak yönetmelikle belirlenir.

 

Bir hayvan; acı, ıstırap ya da zarar görecek şekilde, film çekimi, gösteri, reklam ve benzeri işler için kullanılamaz.

 

The import and export of test animals is subject to permission. This permission is issued by the Ministry of Agriculture and Rural Affairs, having obtained the opinion of the Ministry.

It is forbidden to transfer, sell or receive an animal which is sick, old or lame, or suffering from pain from which it will not recover for any other purpose than to slaughter them according to procedures or to kill them humanely. 

An administrative monetary fine of two thousand five hundred Turkish Lira for those who do not obtain permission for the trade of animals, as specified in article 10, and who do not comply with the related bans and regulatory provisions

Training
ARTICLE 11
– Animals cannot be trained using methods which will cause them to exceed their natural capacity or strength, injure them, cause them unnecessary pain or encourage them to bad habits.  An administrative monetary fine of one thousand two hundred and fifty Turkish Lira for those who act in breach of the bans relating to education in the first paragraph of article 11

It is forbidden to pit animals against other live animals. Traditional shows with folkloric value which do not involve violence may be organised by obtaining permission from the provincial animal welfare committee, with the approval of the Ministry.  An administrative monetary fine of one thousand two hundred and fifty Turkish Lira per animal for those who act in breach of the second paragraph.

FOURTH CHAPTER
Slaughter and Killing of Animals and Bans

Slaughter of animals
ARTICLE 12
– The slaughter of animals will be carried out, taking into account the special conditions required by religious rules, without frightening or startling the animal, in the least painful manner possible, in line with the rules of hygiene and as quickly as possible under the method used. It will be ensured that licensed persons carry out the slaughter of animals.  An administrative monetary fine of five hundred Turkish Lira per animal for those who act in breach of the first paragraph of article 12

Deney hayvanlarının ithalat ve ihracatı izne tâbidir. Bu izin, Bakanlığın görüşü alınarak Tarım ve Köyişleri Bakanlığınca verilir.

Hasta, sakat ve yaşlı durumda bulunan veya iyileşemeyecek derecede ağrısı veya acısı olan bir hayvanı usulüne uygun kesmek ya da ağrısız öldürme amacından başka bir amaçla birine devretmek, satmak veya almak yasaktır.

 

 

 

 

 

 

Eğitim

Madde 11 — Hayvanlar, doğal kapasitesini veya gücünü aşacak şekilde veya yaralanmasına, gereksiz acı çekmesine, kötü alışkanlıklara özendirilmesine neden olacak yöntemlerle eğitilemez.

 

 

 

 

 

Hayvanları başka bir canlı hayvanla dövüştürmek yasaktır. Folklorik amaca yönelik, şiddet içermeyen geleneksel gösteriler, Bakanlığın uygun görüşü alınarak il hayvanları koruma kurullarından izin alınmak suretiyle düzenlenebilir.

 

 

 

 

DÖRDÜNCÜ BÖLÜM

Hayvanların Kesimi, Öldürülmesi ve Yasaklar

 

Hayvanların kesimi

Madde 12 — Hayvanların kesilmesi; dini kuralların gerektirdiği özel koşullar dikkate alınarak hayvanı korkutmadan, ürkütmeden, en az acı verecek şekilde, hijyenik kurallara uyularak ve usulüne uygun olarak bir anda yapılır. Hayvanların kesiminin ehliyetli kişilerce yapılması sağlanır.

 

For those who wish to make a religious sacrifice, the slaughter of animals in as quick and painless a manner as possible in line with religious provisions, hygienic conditions and environmental cleanliness, the slaughter places, the persons who are licensed to slaughter and other related issues will be determined by the Ministry in charge of the Directorate of Religious Affairs, having obtained the opinion of the Ministry and related organisations and institutions.  An administrative monetary fine of one thousand two hundred and fifty Turkish Lira per animal for those who act in breach of the second paragraph.

Killing of animals
ARTICLE 13
– It is forbidden to kill animals unless there are legal exceptions or in case of a medical or scientific necessity; and when there is no food purpose or threat to humans or the environment, pregnant, nursing, and birthing animals may not be killed.

The person or organisation which is responsible for killing an animal is obliged to dispose of the animal’s corpse after it is ascertained that the animal is indeed dead, or have it disposed of. The principles and procedures relating to such killing will be determined in a regulation to be issued by the Ministry.

An administrative monetary fine of five hundred Turkish Lira per animal killed for those who act in breach of the provisions of article 13; an administrative monetary fine of one thousand, two hundred and fifty Turkish Lira per animal killed where the breach is committed by the management.

Bans
ARTICLE 14
– The following actions in relation to animals are banned:

a) To intentionally mistreat animals, to carry out a cruel and unfair action, to beat an animal, leave them hungry or thirsty, to abandon them in extreme heat or cold, to neglect their care or to cause them physical and psychological pain. (250ytl fine)
b) To force an animal to carry out actions that are clearly beyond its strength.  (250ytl fine)

Dini amaçla kurban kesmek isteyenlerin kurbanlarını dini hükümlere, sağlık şartlarına, çevre temizliğine uygun olarak, hayvana en az acı verecek şekilde bir anda kesimi, kesim yerleri, ehliyetli kesim yapacak kişiler ve ilgili diğer hususlar Bakanlık, kurum ve kuruluşların görüşü alınarak, Diyanet İşleri Başkanlığının bağlı olduğu Bakanlıkça çıkarılacak yönetmelikle belirlenir.

 

 

 

 

 

 

Hayvanların öldürülmesi

Madde 13 — Kanunî istisnalar ile tıbbî ve bilimsel gerekçeler ve gıda amaçlı olmayan, insan ve çevre sağlığına yönelen önlenemez tehditler bulunan acil durumlar dışında yavrulama, gebelik ve süt anneliği dönemlerinde hayvanlar öldürülemez.

 

Öldürme işleminden sorumlu kişi ve kuruluşlar, hayvanın kesin olarak öldüğünden emin olunduktan sonra, hayvanın ölüsünü usulüne uygun olarak bertaraf etmek veya ettirmekle yükümlüdürler. Öldürme esas ve usulleri Bakanlıkça çıkarılacak yönetmelikle belirlenir.

 

 

 

 

 

 

 

 

 

Yasaklar

Madde 14 — Hayvanlarla ilgili yasaklar şunlardır:

a) Hayvanlara kasıtlı olarak kötü davranmak, acımasız ve zalimce işlem yapmak, dövmek, aç ve susuz bırakmak, aşırı soğuğa ve sıcağa maruz bırakmak, bakımlarını ihmal etmek, fiziksel ve psikolojik acı çektirmek.

b) Hayvanları, gücünü aştığı açıkça görülen fiillere zorlamak.

 

 

c) To sell domestic pets to persons who have not received training in animal care.  (250ytl fine)
d) To sell domestic pets to those under 16 years of age.  (250ytl fine)
e) To interfere with the body of an animal before it is clear that they have definitely died.  (250ytl fine)
f) To slaughter or kill animals other than slaughter animals, hunting animals which are permitted to be hunted or to be produced as slaughter animals in special production farms within the framework of Law no. 4915 and wild animals which are subject to trade, for their meat and to offer this to the market. (2,500ytl fine)
g) To distribute animals other than those bred for slaughter as prizes, bonuses or premiums. (250ytl fine)
h) To make artificial interventions unless for medical necessity or to supply foreign substances which could damage animals or the young contained in their main stomach or their eggs, apart from the production of caviar. (250ytl fine)
ı) To work animals when they are ill, when 2/3 of their pregnancy is completed or when they have recently given birth, and to shelter them in unsuitable conditions. (250ytl fine)
j) To have sexual relations with animals or to torture them. (250ytl fine)
k) To force feed an animal for reasons not related to health, to give an animal food which may cause pain, suffering or damage, alcoholic drinks, cigarettes, drugs and similar food or drinks which could cause addiction. (250ytl fine)
l) To produce, own, bring into the country, sell or advertise, exchange, display or make a present of an animal which constitutes a danger such as a Pitbull Terrier, Japanese Tosa, etc. (250ytl fine)

An administrative monetary fine of two hundred and fifty Turkish Lira for those who act in breach of paragraphs (a), (b), (c), (d), (e), (g), (h), (ı), (j) and (k) of article 14; an administrative monetary fine of two thousand five hundred Turkish Lira per animal for those who act in breach of the paragraphs (f) and (l), and slaughtered and live animals will be seized.

c) Hayvan bakımı eğitimi almamış kişilerce ev ve süs hayvanı satmak.

d) Ev ve süs hayvanlarını onaltı yaşından küçüklere satmak.

e) Hayvanların kesin olarak öldüğü anlaşılmadan, vücutlarına müdahalelerde bulunmak.

f) Kesim hayvanları ve 4915 sayılı Kanun çerçevesinde avlanmasına ve özel üretim çiftliklerinde kesim hayvanı olarak üretimine izin verilen av hayvanları ile ticarete konu yabani hayvanlar dışındaki hayvanları, et ihtiyacı amacıyla kesip ya da öldürüp piyasaya sürmek.

g) Kesim için yetiştirilmiş hayvanlar dışındaki hayvanları ödül, ikramiye ya da prim olarak dağıtmak.

h) Tıbbî gerekçeler hariç hayvanlara ya da onların ana karnındaki yavrularına veya havyar üretimi hariç yumurtalarına zarar verebilecek sunî müdahaleler yapmak, yabancı maddeler vermek.

ı) Hayvanları hasta, gebelik süresinin 2/3’ünü tamamlamış gebe ve yeni ana iken çalıştırmak, uygun olmayan koşullarda barındırmak.

j) Hayvanlarla cinsel ilişkide bulunmak, işkence yapmak.

k) Sağlık nedenleri ile gerekli olmadıkça bir hayvana zor kullanarak yem yedirmek, acı, ıstırap ya da zarar veren yiyecekler ile alkollü içki, sigara, uyuşturucu ve bunun gibi bağımlılık yapan yiyecek veya içecekler vermek.

l) Pitbull Terrier, Japanese Tosa gibi tehlike arz eden hayvanları üretmek; sahiplendirilmesini, ülkemize girişini, satışını ve reklamını yapmak; takas etmek, sergilemek ve hediye etmek.

 

 

PART THREE
Management of Animal Welfare

CHAPTER ONE

The Organisation, Duties and Responsibilities of Local Animal Welfare Committees

Provincial Animal Welfare Committee ARTICLE 15 – A provincial animal welfare committee will be convened in each province with the Governor as chairperson and for the sole purpose of protecting animals and addressing existing problems and their solutions.

These meetings will be attended by;

a) In metropolitan municipalities, the metropolitan mayor and the mayors of the districts that come under the metropolitan, and in provinces which are not metropolitans, the mayors,
b) Provincial environmental and forestry manager
c) Provincial agricultural manager,
d) Provincial health manager,
e) Provincial education manager,
f) Provincial mufti,
g) Municipal Manager of Veterinary Services,
h) A faculty representative in places where there are veterinary faculties,
ı) At most two representatives of voluntary organisations operating exclusively for the protection of animals and selected with the approval of the Governor.
j) A representative of the provincial or regional chamber of veterinary doctors.

Where deemed necessary by the Committee Chairperson, representatives from other organisations and institutions related to the subject may be requested to attend.

The provincial environment and forestry manager will act as the secretary of the provincial animal welfare committee. As a result of its efforts the committee will notify the Ministry of its main policies, strategy, implementations and opinions. If there is an organisation in a province which does not have a representative, the animal welfare committee will consist of the other members. The committee will meet at the invitation of the committee chairperson.

ÜÇÜNCÜ KISIM

Hayvan Koruma Yönetimi

BİRİNCİ BÖLÜM

Mahallî Hayvan Koruma Kurulları Teşkilât, Görev ve Sorumluluklar

İl hayvanları koruma kurulu

Madde 15 — Her ilde il hayvanları koruma kurulu, valinin başkanlığında, sadece hayvanların korunması ve mevcut sorunlar ile çözümlerine yönelik olmak üzere toplanır.

Bu toplantılara;
a) Büyükşehir belediyesi olan illerde büyükşehir belediye başkanları, büyükşehire bağlı ilçe belediye başkanları, büyükşehir olmayan illerde belediye başkanları,

b) İl çevre ve orman müdürü,

c) İl tarım müdürü,

d) İl sağlık müdürü,

e) İl millî eğitim müdürü,

f) İl müftüsü,

g) Belediyelerin veteriner işleri müdürü,

h) Veteriner fakülteleri olan yerlerde fakülte temsilcisi,

ı) Münhasıran hayvanları koruma ile ilgili faaliyet gösteren gönüllü kuruluşlardan valilik takdiri ile seçilecek en çok iki temsilci,

j) İl veya bölge veteriner hekimler odasından bir temsilci, katılır.

Kurul başkanı gerekli gördüğü durumlarda konuyla ilgili olarak diğer kurum ve kuruluşlardan yetkili isteyebilir.
İl hayvan koruma kurulu sekretaryasını, il çevre ve orman müdürlüğü yürütür. Kurul, çalışmalarının sonucunu, önemli politika, strateji, uygulama, inceleme ve görüşleri Bakanlığa bildirir. İllerde temsilciliği bulunmayan kuruluş var ise il hayvan koruma kurulları diğer üyelerden oluşur. Kurul, kurul başkanı tarafından toplantıya çağrılır.

 

 

The working principles and procedures of the provincial animal welfare committee will be determined by a regulation issued by the Ministry.

Duties of the provincial animal welfare committee
ARTICLE 16 – Animal welfare committees, with the exclusive aim of protecting animals, identifying problems and taking decisions for their solution, and keeping in mind the decisions of the Central Hunting Commission relating to the protection of hunting and wild animals and their habitats and the organisation of hunting, are assigned and authorised;

a) To fulfil the duties indicated in this Law as the legal representative of animals for their protection and during their use,

b) To determine the problems relating to the protection of animals within provincial borders, to devise annual, five year and ten year plans and projects including proposed solutions to animal welfare issues, to prepare annual target reports and submit them for approval by the Ministry, to take all types of measures with the aim of protecting animals, with the approval of the Ministry,

c) To ensure the practical application of the programme prepared by it and to inform the Ministry of its results,

d) To supervise, direct and provide the necessary coordination for the animal welfare activities of various persons, organisations and institutions at a provincial level,

e) To support, develop and take the necessary precautions relating to the animal shelters and animal hospitals to be established in the province,

f) To evaluate the applications of local animal welfare volunteers,

g) To organise educational activities relating to the care, protection and sustenance of animals,

j) To fulfil all duties assigned to it under legislation issued according to this Law.

İl hayvanları koruma kurulunun görevleri

Madde 16 — Hayvanları koruma kurulu münhasıran hayvanların korunması, sorunların tespiti ve çözümlerini karara bağlamak üzere; av ve yaban hayvanlarının ve yaşama alanlarının korunması ve avcılığın düzenlenmesi hususlarında alınmış olan Merkez Av Komisyonu kararlarını göz önünde bulundurarak;

a) Hayvanların korunması ve kullanılmasında onların yasal temsilciliği niteliği ile bu Kanunda belirtilen görevleri yerine getirmek,

b) İl sınırları içinde hayvanların korunmasına ilişkin sorunları belirleyip, koruma sorunlarının çözüm tekliflerini içeren yıllık, beş yıllık ve on yıllık plân ve projeler yapmak, yıllık hedef raporları hazırlayıp Bakanlığın uygun görüşüne sunmak, Bakanlığın olumlu görüşünü alarak hayvanların korunması amacıyla her türlü önlemi almak,

c) Hazırlanan uygulama programlarının uygulanmasını sağlamak ve sonuçtan Bakanlığa bilgi vermek,

d) Hayvanların korunması ile ilgili olarak çeşitli kişi, kurum ve kuruluşların il düzeyindeki faaliyetlerini izlemek, yönlendirmek ve bu konuda gerekli eşgüdümü sağlamak,

e) İlde kurulacak olan hayvan bakımevleri ve hayvan hastanelerini desteklemek, geliştirmek ve gerekli önlemleri almak,

f) Yerel hayvan koruma gönüllülerinin müracaatlarını değerlendirmek,

g) Hayvan sevgisi, korunması ve yaşatılması ile ilgili eğitici faaliyetler düzenlemek,

j) Bu Kanuna göre çıkarılacak mevzuatla verilecek görevleri yapmak, İle görevli ve yükümlüdür.

 

CHAPTER TWO
Supervision and Animal Welfare Volunteers

Supervision
ARTICLE 17 – The Ministry is authorised to monitor whether the provisions of this Law are being complied with or not. Where necessary, the Ministry may assign this authority to the highest local authority via a transfer of authority.

The qualities of supervisory staff and the principles and procedures relating to supervision, the establishment of a registration and monitoring system, reporting obligations and who will report will be determined by a regulation to be issued by the Ministry.

Local authorities are obliged to make arrangements for the registration of domestic pets and OWNERLESS animals.

Responsibilities of local animal welfare officers

ARTICLE 18 – The title local animal welfare officer will be given to volunteers who undertake responsibility for the survival of OWNERLESS animals, in particular cats and dogs, in the environment, areas or neighbourhoods where they are found. These officers will be selected each year by the provincial animal welfare committee from among the members of animal welfare associations and foundations or persons who have provided beneficial services in this area. Local animal welfare officers must carry their documents with them while on duty and these documents must be renewed each year. The documents of persons who are found to have been involved in negative activities will be cancelled. The principles and procedures relating to the duties and responsibilities of local animal officers, the documents to be provided to them, the cancellation of these documents and the training to be given will be determined by a regulation to be issued by the Ministry.

Local animal welfare officers will carry out all their activities relating to OWNERLESS animals in the region or neighbourhood, in particular dogs and cats, in coordination with the local authorities, to include their care, vaccination, the branding of vaccinated animals and the keeping of related records, sterilisation, the retraining of aggressive animals and their relocation to animal shelters established by the local authorities in order to be claimed by owners.

İKİNCİ BÖLÜM
Denetim ve Hayvan Koruma Gönüllüleri

Denetim
Madde 17 —
Bu Kanun hükümlerine uyulup uyulmadığını denetleme yetkisi Bakanlığa aittir. Gerektiğinde bu yetki Bakanlıkça mahallin en büyük mülkî amirine yetki devri suretiyle devredilebilir.
Denetim elemanlarının nitelikleri ve denetime ilişkin usul ve esaslar ile kayıt ve izleme sistemi kurma, bildirim yükümlülüğü ile bunları verecekler hakkındaki usul ve esaslar Bakanlıkça çıkarılacak yönetmelikle belirlenir.
Yerel yönetimler, ev ve süs hayvanları ile SAHIPSIZ hayvanların kayıt altına alınması ile ilgili işlemleri yapmakla yükümlüdürler.

Yerel hayvan koruma görevlilerinin sorumlulukları

Madde 18 — Özellikle kedi ve köpekler gibi SAHIPSIZ hayvanların kendi mekânlarında, bulundukları bölge ve mahallerde yaşamaları sorumluluğunu üstlenen gönüllü kişilere yerel hayvan koruma görevlisi adı verilir. Bu görevliler, hayvan koruma dernek ve vakıflarına üye ya da bu konuda faydalı hizmetler yapmış kişiler arasından il hayvan koruma kurulu tarafından her yıl için seçilir. Yerel hayvan koruma görevlileri görev anında belgelerini taşımak zorundadır ve bu belgelerin her yıl yenilenmesi gerekir. Olumsuz faaliyetleri tespit edilen kişilerin belgeleri iptal edilir. Yerel hayvan görevlilerinin görev ve sorumluluklarına, bu kişilere verilecek belgelere, bu belgelerin iptaline ve verilecek eğitime ilişkin usul ve esaslar Bakanlıkça çıkarılacak yönetmelikle belirlenir.

 

 

Yerel hayvan koruma görevlileri; bölge ve mahallerindeki, öncelikle köpekler ve kediler olmak üzere, SAHIPSIZ hayvanların bakımları, aşılarının yapılması, aşılı hayvanların markalanması ve kayıtlarının tutulmasının sağlanması, kısırlaştırılması, saldırgan olanların eğitilmesi ve sahiplendirilmelerinin yapılması için yerel yönetimler tarafından kurulan hayvan bakımevlerine gönderilmesi gibi yapılan tüm faaliyetleri yerel yönetimler ile eşgüdümlü olarak yaparlar.

Support for Animal Welfare

Financial Support
ARTICLE 19 – Financial support in an amount approved by the Ministry will be provided in particular to local authorities or to other related organisations and institutions for the establishment of animal shelters or hospitals for the protection of domestic pets and the execution of care, rehabilitation, vaccination and sterilisation activities. The necessary appropriations will be made in the Ministerial budget for this purpose. The principles and procedures relating to the use of these appropriations will be determined by a regulation to be issued by the Ministry having obtained the approval of the Ministry of Finance.

Other Provisions

Educational Boardcasts
ARTICLE 20– In order to promote the protection and welfare of animals, programs aimed at general and formal education should be made and broadcasting time should be reserved for these issues on radio and television programmes. Both the Turkish Radio and Television Board and the private television channels should reserve at least two hours a month and private radio stations should reserve at least half an hour a month for educational broadcasts. 20% of these broadcasts must take place at peak viewing or listening times. The Ministry of Education and the Radio and Television High Board are liable for the monitoring of the issues in this article which are related to their area of duty.  Radio and television stations are fined five thousand Turkish Lira for violations of article 20.

Madde 19 —
Ev ve süs hayvanlarının korunması amacıyla bakımevleri ve hastaneler kurmak; buralarda bakım, rehabilitasyon, aşılama ve kısırlaştırma gibi faaliyetleri yürütmek için, başta yerel yönetimler olmak üzere diğer ilgili kurum ve kuruluşlara Bakanlıkça uygun görülen miktarlarda mali destek sağlanır. Bu amaçla Bakanlık bütçesine gerekli ödenek konulur. Bu ödeneğin kullanımına ilişkin esas ve usuller, Maliye Bakanlığının olumlu görüşü alınmak suretiyle Bakanlıkça çıkarılacak yönetmelikle belirlenir.

Madde 20 —
Hayvanların korunması ve refahı amacıyla; yaygın ve örgün eğitime yönelik programların yapılması, radyo ve televizyon programlarında bu konuya yer verilmesi esastır. Türkiye Radyo ve Televizyon Kurumu ile özel televizyon kanallarına ait televizyon programlarında ayda en az iki saat, özel radyo kanallarının programlarında ise ayda en az yarım saat eğitici yayınların yapılması zorunludur. Bu yayınların % 20’sinin izlenme ve dinlenme oranı en yüksek saatlerde yapılması esastır. Radyo ve Televizyon Üst Kurulu görev alanına giren hususlarda bu maddenin takibi ile yükümlüdür.

 

 

Traffic Accidents

ARTICLE 21A driver who hits and harms an animal must take them or ensure that they are taken to the nearest veterinary doctor or treatment unit.  An administrative monetary fine of two hundred and fifty Turkish Lira per animal for those who act in breach of article 21.

Zoos

ARTICLE 22 – Management and municipalities are obliged to arrange zoos in a manner suited to natural habitats, or ensure that they are so arranged. The principles and procedures relating to the establishment and operation of zoos will be determined by a regulation issued by the Ministry having obtained the opinion of the Ministry of Agriculture and Rural Affairs.  An administrative monetary fine of six hundred Turkish Lira per animal kept under inappropriate conditions in zoos for those who do not comply with article 22

Bans and permissions

ARTICLE 23 – The Ministry of Agriculture and Rural Affairs, having obtained the opinion of the Ministry, is authorised in relation to all types of permission and transactions relating to the trade of domestic pets which come within the scope of this Law, their import and export and their removal from or bringing into the country in any manner whatsoever. The related units of the Ministry of Agriculture and Rural Affairs will provide the Ministry with information on imports and exports executed during the year.  An administrative monetary fine of two thousand five hundred Turkish Lira per animal for those who act in breach of article 23

Taking animals into care

ARTICLE 24Persons who act in breach of the provisions of this Law relating to animal welfare and who in this manner seriously neglect the animals in their care or cause them pain, suffering or damage will be banned from keeping animals by the supervisory authorities and the animals will be seized. The said animals will be given to new owners or taken into care.

Madde 23 — Bu Kanun kapsamında olan ev ve süs hayvanlarının ticaretinin yapılması, ithalatı ve ihracatı ile her ne şekilde olursa olsun, ülkeden çıkarılması ve sokulması ile ilgili her türlü izin ve işlemlerde Bakanlığın görüşü alınmak kaydıyla Tarım ve Köyişleri Bakanlığı yetkilidir. Tarım ve Köyişleri Bakanlığının ilgili birimlerince, yıl içinde yapılan ithalat ve ihracat ile ilgili bilgiler Bakanlığa bildirilir.

Koruma altına alma

Madde 24 — Bu Kanunun hayvanları korumaya yönelik hükümlerine aykırı hareket eden ve bu suretle bulundurduğu hayvanların bakımını ciddi şekilde ihmal eden ya da onlara ağrı, acı veya zarar veren kişilerin denetimle yetkili merci tarafından hayvan bulundurması yasaklanır ve hayvanlarına el konulur. Söz konusu hayvan yeniden sahiplendirilir ya da koruma altına alınır.

 

 

CHAPTER FOUR

Penal Provisions

CHAPTER ONE

Authority to impose Administrative Monetary Fines, Fine Payment Period, Collection and Objections

Authority to impose Administrative Monetary Fines
ARTICLE 25
– The administrative monetary fines set forth in this Law will be imposed by the supervisory authorities indicated in article 17 of this Law.

Objections to Administrative Fines
ARTICLE 26
– Proceedings against administrative monetary fines can be lodged with the administrative courts within fifteen days of notification of the fine. The lodging of proceedings does not halt the fulfilment of the fine imposed by the administration. The decision of the administrative court on this issue is final.

Administrative Monetary Fines Payment Period and Collection

ARTICLE 27 – The payment period for administrative monetary fines is thirty days from the date of notification of the fine.

The monetary fines imposed by the authorised agencies in a receipt printed and distributed by the Ministry will be paid to the highest collection office of the locality. 80% of the money paid will be transferred to the related municipality during the following month. This money is regarded as allocated and cannot be used for other purposes. The principles and procedures relating to the format, distribution and control of the receipts to be used for administrative monetary fines imposed under this Law will be determined by a regulation.

Monetary fines which are not paid within the specified period will be collected, together with default increases, according to the provisions of Law no. 6183 concerning the Procedure for the Collection of Public Receivables

BİRİNCİ BÖLÜM

İdari Para Cezası Verme Yetkisi, Cezalar, Ödeme Süresi, Tahsil ve İtiraz

İdarî para cezası verme yetkisi

Madde 25 — Bu Kanunda öngörülen idarî para cezaları bu Kanunun 17 nci maddesinde belirtilen denetime yetkili merci tarafından verilir.

İdari para cezalarına itiraz
Madde 26 — İdarî para cezalarına karşı cezanın tebliği tarihinden itibaren onbeş gün içinde idare mahkemesine dava açılabilir. Davanın açılmış olması idarece verilen cezanın yerine getirilmesini durdurmaz. Bu konuda idare mahkemelerinin verdiği kararlar kesindir.

İdarî para cezalarının ödenme süresi ve tahsili

Madde 27 — İdarî para cezalarının ödenme süresi cezanın tebliği tarihinden itibaren otuz gündür.

Ceza vermeye yetkili merciler tarafından, Bakanlıkça bastırılan ve dağıtılan makbuz karşılığında verilen para cezaları, ilgilileri tarafından mahallin en büyük mal memurluğuna yatırılır. Yatırılan paranın % 80’i ilgili belediyeye takip eden ay içinde aktarılır. Bu para, tahsisi mahiyette olup amacı dışında kullanılamaz. Bu Kanuna göre verilecek idarî para cezalarında kullanılacak makbuzların şekli, dağıtımı ve kontrolü ile ilgili esas ve usuller yönetmelikle belirlenir.

Öngörülen süre içinde ödenmeyen para cezaları, gecikme zammı ile birlikte 6183 sayılı Amme Alacaklarının Tahsil Usulü Hakkında Kanun hükümlerine göre tahsil edilir.

 

 

 

 

Fines

ARTICLE 28 – The following fines will be imposed for behaviour in breach of the provisions of this Law:

a) An administrative monetary fine of two hundred and fifty million Turkish Lira per animal for those who act in breach of the provision of the second sentence of paragraph (k) of article 4.
b) An administrative monetary fine of fifty million Turkish Lira per animal for those who act in breach of the provisions of the first, second, third and sixth paragraphs of article 5 by failing to comply with the bans and obligations relating to the ownership and care of animals or failing to take the necessary precautions, and of one hundred and fifty million Turkish Lira per animal for those who fail to comply with the bans and obligations in paragraph 7.
c) An administrative monetary fine of five hundred million Turkish Lira per animal for those who act in breach of the first paragraph of article 6.
d) An administrative monetary fine of one hundred and fifty million Turkish Lira per animal for those who act in breach of the provisions relating to surgical interventions set forth in article 7.
e) An administrative monetary fine of seven and a half billion Turkish Lira per animal for those who act in a manner that could cause the extinction of an animal species as set forth in the first paragraph of article 8; an administrative monetary fine of one and a half billion Turkish Lira for those who fail to comply with paragraphs two, three and four.
f) An administrative monetary fine of two hundred and fifty million Turkish Lira per animal for those who fail to comply with article 9 and the issues contained in the regulations issued; an administrative monetary fine of one billion Turkish Lira per animal for those who carry out unauthorised animal testing.
g) An administrative monetary fine of two billion five hundred million Turkish Lira for those who do not obtain permission for the trade of animals, as specified in article 10, and who do not comply with the related bans and regulatory provisions.

Cezalar

Madde 28 — Bu Kanun hükümlerine aykırı davrananlara aşağıdaki cezalar verilir:

a) 4 üncü maddenin (k) bendinin ikinci cümlesi hükmüne aykırı davrananlara, hayvan başına ikiyüzellimilyon lira idarî para cezası.

b) 5 inci maddenin birinci, ikinci, üçüncü ve altıncı fıkralarında öngörülen hayvanların sahiplenilmesi ve bakımı ile ilgili yasaklara ve yükümlülüklere uymayan ve alınması gereken önlemleri almayanlara hayvan başına ellimilyon lira, yedinci fıkrasında öngörülen yükümlülük ve yasaklara uymayanlara hayvan başına yüzellimilyon lira idarî para cezası.

c) 6 ncı maddenin birinci fıkrasına aykırı hareket edenlere hayvan başına beşyüzmilyon lira idarî para cezası.

d) 7 nci maddede yazılan cerrahi amaçlı müdahaleler ile ilgili hükümlere aykırı davrananlara hayvan başına yüzellimilyon lira idarî para cezası.

e) 8 inci maddenin birinci fıkrasında yazılı, bir hayvan neslini yok edecek müdahalede bulunanlara hayvan başına yedibuçukmilyar lira idarî para cezası; ikinci, üçüncü ve dördüncü fıkralarına uymayanlara hayvan başına birmilyar lira idarî para cezası.

f) 9 uncu maddede ve çıkarılacak yönetmeliklerinde belirtilen hususlara uymayanlara hayvan başına ikiyüzellimilyon lira; yetkisi olmadığı halde hayvan deneyi yapanlara hayvan başına birmilyar lira idarî para cezası.

g) 10 uncu maddede belirtilen hayvan ticareti izni almayanlara ve bu konudaki yasaklara ve yönetmelik hükümlerine aykırı davrananlara ikimilyarbeşyüzmilyon lira idarî para cezası.

 

 

h) An administrative monetary fine of one billion two hundred and fifty million Turkish Lira for those who act in breach of the bans relating to education in the first paragraph of article 11, an administrative monetary fine of one billion two hundred and fifty million Turkish Lira per animal for those who act in breach of the second paragraph.
ı) An administrative monetary fine of five hundred million Turkish Lira per animal for those who act in breach of the first paragraph of article 12; an administrative monetary fine of one billion two hundred and fifty million Turkish Lira per animal for those who act in breach of the second paragraph.
j) An administrative monetary fine of five hundred million Turkish Lira per animal killed for those who act in breach of the provisions of article 13; an administrative monetary fine of one billion, two hundred and fifty million Turkish Lira per animal killed where the breach is committed by the management.
k) An administrative monetary fine of two hundred and fifty million Turkish Lira for those who act in breach of paragraphs (a), (b), (c), (d), (e), (g), (h), (ı), (j) and (k) of article 14; an administrative monetary fine of two billion five hundred million Turkish Lira per animal for those who act in breach of the paragraphs (f) and (l), and slaughtered and live animals will be seized.
l) Radio and television stations are fined five billion Turkish Lira for violations of Madde 20.

m) An administrative monetary fine of two hundred and fifty million Turkish Lira per animal for those who act in breach of article 21.
n) An administrative monetary fine of six hundred million Turkish Lira per animal kept under inappropriate conditions in zoos for those who do not comply with article 22.
o) An administrative monetary fine of two billion five hundred million Turkish Lira per animal for those who act in breach of article 23.

h) 11 inci maddenin birinci fıkrasındaki eğitim ile ilgili yasaklara aykırı davrananlara birmilyarikiyüzellimilyon lira, ikinci fıkrasına aykırı davrananlara hayvan başına birmilyarikiyüzellimilyon lira idarî para cezası.

ı) 12 nci maddenin birinci fıkrasına aykırı hareket edenlere hayvan başına beşyüzmilyon lira; ikinci fıkrasına aykırı hareket edenlere hayvan başına birmilyarikiyüzellimilyon lira idarî para cezası.

j) 13 üncü madde hükümlerine aykırı davrananlara, öldürülen hayvan başına beşyüzmilyon lira idarî para cezası, aykırı davranışların işletmelerce gösterilmesi halinde öldürülen hayvan başına birmilyarikiyüzellimilyon lira idarî para cezası.

k) 14 üncü maddenin (a), (b), (c), (d), (e), (g), (h), (ı), (j) ve (k) bentlerine aykırı davrananlara ikiyüzellimilyon lira idarî para cezası; (f) ve (l) bentlerine aykırı davrananlara hayvan başına ikimilyarbeşyüzmilyon lira idarî para cezası verilir, kesilmiş ve canlı hayvanlara el konulur.

l) RTÜK’ün takibi sonucunda 20 nci maddeye aykırı hareket ettiği tespit edilen ulusal radyo ve televizyon kurum ve kuruluşlarına maddenin ihlal edildiği her ay için beşmilyar lira idarî para cezası.

m) 21 inci maddeye aykırı hareket edenlere hayvan başına ikiyüzellimilyon lira idarî para cezası.

n) 22 nci maddeye uymayanlara, hayvanat bahçelerinde kötü şartlarda barındırdıkları hayvan başına altıyüzmilyon lira idarî para cezası.

o) 23 üncü maddeye aykırı hareket edenlere hayvan başına ikimilyarbeşyüzmilyon lira idarî para cezası.

 

 

 

 

If the actions in paragraphs one, two and five of article 5, as referred to in paragraph (b) of this article, and actions apart from paragraph (n) are carried out by a veterinary doctor, a veterinary health technician, an animal welfare volunteer, a member of an animal welfare association or foundation or persons appointed to round up, supervise, care for or protect animals, the fine to be imposed will be doubled.

The monetary fines set forth in this article will be applied after being increased by the annual revaluation rate identified and announced according to the provisions of article 298 of the Tax Procedures Law no. 213, dated 04.01.1961, and valid from the beginning of that calendar year.

Bu maddenin (b) bendinde atıfta bulunulan 5 inci maddenin birinci, ikinci ve beşinci fıkraları ile (o) bendi dışında kalan fiillerin, veteriner hekim, veteriner sağlık teknisyeni, hayvan koruma gönüllüsü, hayvan koruma derneği üyeleri, hayvan koruma vakfı üyeleri, hayvan toplama, gözetim altına alma, bakma, koruma ile görevlendirilmiş olan kişilerce işlenmesi halinde verilecek ceza iki kat artırılarak uygulanır.

Bu maddede yazılı idarî para cezaları, her takvim yılı başından geçerli olmak üzere, o yıl için 4.1.1961 tarihli ve 213 sayılı Vergi Usul Kanununun mükerrer 298 inci maddesi hükümleri uyarınca tespit ve ilân edilen yeniden değerleme oranında artırılarak uygulanır.

 

 

PART FIVE
Various, Final and Provisional Provisions

CHAPTER ONE
Various Provisions

Breach of more than one provision
ARTICLE 29
– If any of the actions set forth as a crime in this Law are at the same time viewed as crimes under other laws, the legal provision requiring the heaviest punishment will be applied.

Those who by their actions breach more than one provision of this Law will be penalised with the heavier punishment.

Repetition of Actions
ARTICLE 30
– If actions which have been penalised under the provisions of this Law are repeated, the monetary fines to be imposed will be doubled and for further repetitions tripled.

CHAPTER TWO
Final, Provisional Provisions

Reserved Provisions
ARTICLE 31
– The provisions of the Territorial Hunting Law no. 4915, the Animal Health and Police Law no. 3285, the Animal Amendment Law no. 4631 and the Water Products Law no. 1380 are reserved.

Madde 29 —
Bu Kanunda suç olarak öngörülen fiiller başka kanunlara göre de suç ise, en ağır cezayı gerektiren kanun hükümleri uygulanır.

Fiili ile bu Kanunun birden fazla hükmünü ihlal edenlere daha ağır olan ceza verilir.

Madde 30 —
Bu Kanunda, ceza hükmü altına alınmış fiillerin tekrarı halinde para cezaları bir kat, daha fazla tekrarı halinde üç kat artırılarak verilir.

Madde 31 —
4915 sayılı Kara Avcılığı Kanunu, 3285 sayılı Hayvan Sağlığı ve Zabıtası Kanunu, 4631 sayılı Hayvan Islahı Kanunu ile 1380 sayılı Su Ürünleri Kanunu hükümleri saklıdır.

 

 

PROVISIONAL ARTICLE 1Of the animals indicated in paragraph (l) of article 14 of this Law, the owners of those who have been brought into the country before this Law came into effect must notify these to animal welfare committees within three months and have them registered, and they must provide documents showing whether they have been sterilised or not to the provincial animal welfare committee within six months.

PROVISIONAL ARTICLE 2 – The regulations which are to be issued under this Law will be prepared within a year of the coming into effect of this Law.

Effect

ARTICLE 32– This Law comes into effect on its date of publication.

Execution

ARTICLE 33 – The provisions of this Law will be executed by the Council of Ministers

 

GEÇİCİ Madde 1 — Bu Kanunun 14 üncü maddesinin (l) bendinde belirtilen hayvanlardan, yurda bu Kanunun yürürlüğe girdiği tarihten önce sokulmuş olanların sahipleri; üç ay içerisinde hayvan koruma kurullarına bildirimde bulunarak bunları kayıt altına aldırmak; altı ay içerisinde kısırlaştırarak kısırlaştırıldıklarına ilişkin belgeleri il hayvan koruma kurullarına teslim etmek zorundadırlar.

GEÇİCİ MADDE 2 — Bu Kanun gereğince çıkarılması gerekli bulunan yönetmelikler, Kanunun yürürlüğe girdiği tarihten itibaren bir yıl içinde hazırlanır.

Yürürlük

Madde 32 — Bu Kanun yayımı tarihinde yürürlüğe girer.

Yürütme

Madde 33 — Bu Kanun hükümlerini Bakanlar Kurulu yürütür.

Didim Public Education discusses new courses

THE activities and projects to be carried out by the Directorate of Didim Public Education Center in 2018 were discussed at a recent meeting.

Didim Garrison Commander Cetin Gülseven, Didim District Police Chief Serkan Demircioğlu, Didim District National Education Director Recep Akdemir, Didim Chamber of Commerce President Şaban Üstündağ, Didim Chamber of Art and Artisans Yaşar Pektaşoğlu, Didim Chamber of Agriculture President Bahattin Gökdemir and Profession Organizations representatives and school principals were all in attendance.

Speaking at the meeting, Didim Public Education Center Director Nuri Öner pointed out the number of courses for the last 3 years and stated that in 2017 691 courses were opened and 15,898 trainees attended the courses.

Employment courses opened with the support of İş-Kur, as well as joint courses with professional organizations, stating that they continue to be a lot of courses throughout the year.

Discussions with institutions and the courses to be determined on will be negotiated further and details of the courses will be announced in due course.

Mayor cements ties with Dumlupınar

Didim Mayor Ahmet Deniz Atabay visited Kütahya’s district Dumlupınar, in Diyarbakır , and spoke with Mayor Niyazi Tezcan.

Dumlupınar Mayor Niyazi Tezcan, who accepted Mayor Atabay and Didim Municipal Assembly members in his office, stated his satisfaction from the visit.

He said: “We discussed how we can work together with the Mayor of Didim and members of the Assembly. I hope that we will have a beautiful project. Thank you for that, “he said.

 

DIDIM is to host an official half-marathon in October in conjunction with the Turkey Athletics Federation, it has been revealed.

Mayor Deniz Atabay said preparations are now underway to fulfil all the necessary requirements of the Association for the half marathon over the October 6-7 weekend.

He was quoted as saying that landmarks such as Republic Square, Altinkum and Temple of Apollo would be on the route.

The council is in talks with the Head of the Athletics Federation, Münir Yavaş and his team to draw in international and domestic participants.

Rain stops play in Didim

HEAVY rains caused people to stay indoors and those caught in it were left dashing for cover in Didim yesterday.

Such was the force of the rain that cars opted to pull over and wait out the rains, while citizens who were walking the pavements ran for shelter.

The council dispatched squads of workers to help the worst affected areas across the resort.

Animal supporters protest violence

Members of the Didim Animal Protection Association organized a protest throughout the district to draw attention to the violence against street animals.

They staged a demonstration outside the central mosque. Association president, Şengül Güz, commented: “Violence against animals is just as abhorrent as violence against humans. Unfortunately, incidents of violence against innocent and vulnerable animals have increased in our county, which makes us very uncomfortable.”

Şengül Güz, emphasizing that we must act sensitively in the face of violence said “If you witness violence against animals, you should file a complaint to the ministry of forestry and water affairs. We expect that be responsive to street animals from all citizens.”

Car fire in Didim

In Didim, a car was engulfed in flames, but the driver Şefik Şahin escaped without injury.

The car burst into flames on Cumhuriyet Caddesi. Şahin while leaving the car, called the fire brigade who came to the scene and extinguished the fire in a short time.

Sewer work continues

Didim Mayor Deniz Atabay has carried out a visit to ongoing works of the Akbuk Sewerage Pipeline, and confirming that the plans and programs are on schedule.

Meeting with the Akbük citizens, he listened to their problems, while examining the ongoing works at various points in the field.

Atabay pointed out they had made great efforts to get the works underway, adding: “We hope to complete the work in the shortest time. We will continue to carry out regular inspections.”

 

Tour operator Prestige Tours, part of the Turkish group Calypso Tour, is to begin bus links from Romania to Marmaris and Didim.

Prestige Tours will be introducing the new business line – a bus line to Marmaris and Didim, with five weekly departures from Bucharest and Craiova.

“Due to the large number of requests for trips to Turkey and the high degree of occupancy on the charter flights we have, we decided to focus on a new line of business.

“Marmaris and Didim are the first destinations we operate by bus, but, depending on results we are considering to launch other destinations,” Elena Anghel, Prestige Tours managing partner.

Bus tours to the Turkish seaside will be operated between May-October 2018.

In 2017, 20,000 tourists traveled with Prestige Tours to Antalya.

In 2016, Prestige Tours expanded the number of flights from other cities apart from Bucharest, by including a flight from Suceava to Antalya, its main destination.  The occupancy rate of over 98 percent of flights from this city, as well as from Cluj-Napoca and Arad, made the company eager to expand at a national level in 2018 as well, and to introduce a charter to Antalya from Craiova.

POLICE have detained two people for the possession of counterfeit whiskey that was to be peddled for sale in bars across Didim and Akbuk.

Didim District Police Department Anti-Smuggling and Organized Crimes Combat (KOM) Group Amirlik teams said officers discovered the illicit whiskey in cardboard boxes in a vehicle.

Two men, aged 21 and 24, were detained for questioning and the latter was released while inquiries continue.

 

A SECOND operation into migrant smuggling through Didim to Greece has led to a fresh wave of arrested.

Several people were brought to Didim court by Gendarme officials yesterday with an ongoing investigation centred of smuggling mainly Afghan nationals to Europe.

The first operation led to the arrest of three people, and the second raid led to 11 people, including an Afghan national, being detained.

The suspects in the second operation were brought to court yesterday under the gaze of the local media.

They were detained for alleged smuggling and human trafficking.

During the raids, officers seized mobile phones, boats and boat engines.e suspects had previously been arrested. Thus, the number of arrested reached 11. – Aydın

A 42-YEAR-OLD man from Akbuk has been detained in custody for 61 crimes, mainly fraud and credit card misuse.

The man, identified only be his initials O.A., was detained by police at an address in the resort and brought to Didim court to be remanded to custody.

According to the information obtained; Didim District Police Department Public Security Bureau said OA had been accused of many fraud incidents.

These, included abuse of information systems, theft, bank and credit card misuse, fraudulent bankruptcy and similar crimes.

 

Summer bookings to Turkey by German travellers have increased by 70 percent compared with a year ago, Europe’s largest holiday operator TUI Group announced today (Wednesday).

“After two years of decline, Turkey has again become a favourite destination for German holidaymakers, with a 70 percent increase in bookings at the start of the season,” the German tour operator said in a press release to AA.

TUI group announced hundreds of extra flights to Turkey’s most popular tourist destination Antalya, and added almost 100,000 seats from German cities Hamburg, Hannover, Frankfurt, Leipzig, Dusseldorf, Cologne, Nuremberg, Munich and Stuttgart.

Turkey has been one of the most popular travel destinations for German holidaymakers, but the number of visitors declined in the last two years, amid political tensions between Ankara and Berlin.

Turkish Foreign Minister Mevlut Cavusoglu met with his German counterpart Sigmar Gabriel in Goslar last week and discussed ways to improve ties between the two countries.

A NEW tennis academy centre was established this week at the Aquasis Hotel.

Didim Mayor Deniz Atabay attended the first session and with the trainees while playing tennis for the first time.

Didim Tennis Academy President Seyhan Heb “The Academy is aimed at developing and promoting tennis as a sports in the province.”

The sessions are available for people aged from seven to 77.

The academy is equipped with four enclosed tennis courts and teaching sessions for children and adults are available.

He said all training coaches will be graduates from physical education and sports school, as well as second and third level coaches who have made a career in their fields.

Mr Heb added: “We would like to contribute to the promotion of Didim and create tennis tourism in Didim.”

He aims to create a tournament open to 300 to 400 internationals in May.

Mr Atabay stated: “It is pleasing to have different sports branches in Didim.”

 

SEVERAL arrests have been made across Turkey following an investigation into the smuggling of Afghan nationals through Didim and on to Europe.

Suspects at 11 different addresses, including at least one from Afghanistan living in Aydin, were arrested.

Aydin Provincial Gendarmerie Command, Anti-Smuggling and Organized Crime Branch launched a specific investigation some months ago. It was as a result of their work that led to the arrests.

Police teams also seized boat engines, a rubber boat and one fiberglass boat, which were planned to be used in migrant smuggling. They also seized 15 mobile phones.

Three of the suspects were arrested while the others were released pending further inquiries.

 

Bust stolen from park

A BUST of the father of medicine, Hippocrates, has disappeared from its plinth in a park in Didim’s Camlik district.

The design, by Antonis Chatzimizhail, was completed in three months and was put in the park at a ceremony in 2015. It was stolen from the place by an unknown person or people.

The opening ceremony was attended by Didim Mayor Deniz Atabay, members of the Didim Municipal Assembly, former President of the Didim Rotary Club, Serkan Bayar and Kos Rotary Club President Tasos Spirou, who came to the county.

That same day it was said a similar sculpture would be placed on the Greek island of Kos.

Officer’s name to live on

FETHI Sekin’s name, a police officer killed when he stopped terrorists from an attack in front of İzmir Courthouse, is to live on in Didim.

Didim Council decided that the name of a new park in 1484 Sokak, Efeler district, will be named Martyr Police Fethiye Sekin Park.

At the opening ceremony tomorrow (Friday January 5), 1500 people will be served a meal led by Bünyamin Karhan from Didim’s tourism tradesman. The opening is expected to be attended by Aydin Governor Selim Köşger, Didim District Governor Mehmet Türköz, Mayor of Didim Ahmet Deniz Atabay, General Director of Alevi Culture Association Doğan Demir and representatives of civil society organizations.

Karman said: “There would have been a massacre in İzmir, but for our martyr police who alone prevented this massacre. We do not forget the martyred police, his name will live on in this park.”

Volunteers come together for animals

VOLUNTEERS are providing much needed help at the Didim Animal Shelter.

Foreign and Turkish residents are helping to clean the shelter, feed the dogs, walk them, as well as attending to their medical needs.

The citizens who volunteered to visit the animals at the shelter said “Every day we come to the shelter, we walk the dogs and fulfil their needs, and we want to make them happy.”

Other animal lovers who serve at the shelter also routinely stated that they helped with cleaning and maintenance works and stated that they made animal shelters from pallets for protection from cold in winter and from rain.

The Didim Municipality Animal Shelter in charge of veterinarians Ali Karahallı praised the work of the volunteers.

46 refugees caught in Didim

A TOTAL of 46 immigrants, who wanted to escape to Greece illegally, were caught off the coast of Didim.

The group, including a large number of children, were trying to escape to the Greek islands on two inflatable boats. Most of them were from Palestine and Syria.

They were taken to the Didim Police Headquarters and handed over to the Foreigners Department Directorate of Aydın Provincial Security Directorate for processing.

2.5 million tonnes of coal for Didim’s needy families

The Didim District Office and Social Assistance and Solidarity Foundation, headed up by the Didim Governor,  is to hand over 2.5 million tons of coal to families in need.

Governor Mehmet Türköz said the coal will be handed to 470 families this year. Citizens living in the villages around Didim were given 1.5 tonnes and 1 ton per family in the center. In 2017, the foundation fully provided 861,777TL of aid from the foundation’s budget.

Hacer Solgun, Director of Social Assistance and Solidarity Foundation, and 4 staff members helped provide the aid to families with children in need, children who are not covered by the education costs, and soldiers and martyrs’ families.

Didim schools apply for science research

TEN projects from ten schools in Didim were submitted to the Science and Society programme, organized in coordination with the Department of Scientific and Technological Research Council of Turkey (TUBITAK).

Recep Akdemir, Director of National Education at Didim District, stated that 10 schools in Didim applied to the project and were accepted. Akdemir said: “To increase the scientific research between the 5th and 12th-grade students, 5,000TL will be provided for the projects of each school where the applications are accepted. In this sense, a source of 50,000 TL will be transferred to the education of our district.”

The applicant schools are: Akköy Middle School, Akyeniköy Şehit Soner Turan Middle School, Cemal Ergenekon Middle School, Denizköy School, Efeler Middle School, Selçuk Özsoy Middle School, Valiler Middle School, Didim Anatolian High School, Vocational and Technical Anatolian High School, and Yalıköy Middle School.

JET2 has added an extra 600,000 seats to Turkey for 2018 after seeing a ‘huge surge’ in bookings.

The company said there had been a fourfold increase in bookings to Antalya, while Bodrum and Dalaman had attracted more than twice as many bookings as this time last year.

Italy and Croatia are also seeing huge growth, said Jet2, as are the Greek islands and Cyprus. The operator said its customers were looking to explore new and undiscovered regions, demonstrated by a growth in bookings to Costa de Almeria and the Greek Island of Halkidiki.

A TOURISM official has claimed that 45,000 Brits will be heading to Didim in 2018 – with at least one hotel stating its is already 50 percent full for the coming holiday season.

Tayyar Cengiz, the President of Didim Tourism Association, said some 30,000 Brits visited the resort in 2017 but that had already been trumped by early bookings in the order of 45,000 for summer 2018.

Mr Cengiz, who shared the knowledge that hoteliers are positive for this year, said: “Hotels have informed us that their businesses are selling 50 percent of bed numbers to the British.”

Cengiz said he hoped the rate would be even higher and that improvements were encouraging, as the number of charter planes had increased from 9 to 12 per week, and that the planes had increased seat requirements by as much as 60 percent.

He added there had also been an increase in interest from the domestic sector.

Aquasis Hotel Manager Ahmet Baş confirmed that he had seen a three-fold increase in bookings. He said: “We are looking at at least 50 percent bookings and are optimistic that we may reach upwards of 100 percent as the season approaches.”

HOME owners in Akbuk have been told that previous years’ demands for money to fund the sewer connection infrastructure across the resort have finally been cancelled.

Erdogan Öztürk, the general manager of Aydin council’s water/sewer dept, ASKI, came to Akbük personally and addressed the public at a recent meeting organized by Akbük Culture and Environment Association (AKÇED).

He explained that the whole of the water participation share notice and demands on residents for previous years’ demands were now invalidated.

AKÇED has made a great effort to solve the problem and had launched legal proceedings, with its president Ferda Kılıç saying that the demand for money for sewer connections was contrary to the law. As a result, the organisation opened numerous lawsuits and won all of them.

However, the debts of those who did not open the legal cases continued to exist on ASKI’s computer records, and interest was added to them every day.

In response to this development, AKÇED appealed to Mayor Deniz Atabay to address the matter. He approached Mr Ozturk, and following a meeting with Aydin Mayor Özlem Çerçioğlu, the order to cancel all outstanding debts against Akbuk homeowners in relation to the ‘sewer connection tax’ was cancelled.

MrOzturk followed this up appearing at the AKÇED meeting to confirm the news.

Mr Kılıç said: “As a result, the law has come back to Akbük. We warned the local government units, but they did not listen to us. Today, the development is pleasing. I would like to express my sincere appreciation to all the victims of Akbük who have contributed to this endeavor and have made an effort. “

We have information suggesting a private health centre – not Soke’s Egemed which is set will to have a branch located elsewhere in town – will be located next to the Sunshine Complex, in Hisar district.
