Hammer blow

FAMILIES and couples at a complex in Altinkum have had their homes repossessed and could see them auctioned off as creditors seek to recover a builder’s mountain of debt - estimated in excess of 500,000 TL (£200,000).

Twelve of 17 apartments have been seized by creditors who are looking to recover debts or loans rattled up by builder Altay Cetin who is reportedly in prison for fraud.

Voices understands that about 15 creditors are chasing repayments and these include businesses and even government departments.

Couple Pam and Ian Burrell, of Worthing, west Sussex, have learnt their apartment, at Safir apartments, Selanik Caddesi, Sokak 881, in Yeni Mahalle, is one of the 12 apartments that are planned to be put up for auction in Didim on Monday September 7.

They bought their property off plan in April 2004 with them handing over a total of £35,000 on completion in March, the following year.

They were guided to an estate agent called Blue Sea Real Estate acting as agent for the builder for the issuing of title deeds, but these have never been issued.

They learnt this week that creditors seeking to recoup debts from Çetin have put restraints on 12 apartments in the complex and intend to have them auctioned off.

The Burrells, along with four other affected parties who bought at Safir, have turned to solicitor Nesrin Sandalcı to launch a last ditch bid to stop the auction going ahead and to secure the title deeds on the apartments

Mrs Burrell said: “We are absolutely devastated by the news that we could lose our apartment even though we have been using it for some time to enjoy holidays.

“This was in the firm belief that the title deeds were being applied for as Army searches had been granted. It is a nightmare situation that is not of our making.

“We are all sick with worry and anxious that the apartments are not auctioned off in September. Our hopes now rest with our solicitor who I understand is trying through the courts to get the restraints placed by the creditors lifted.”

She added: “We are all desperate that this scandal has occurred and now time is running out fast.”

Ms Sandalcı said: “I understand that people, certainly my clients, have bought on the complex but have been unable to secure their property title deeds in their names.

“We are taking matters step by step with the aim of getting the restraints placed by the builder’s creditors lifted and to stop the auction going ahead. Once that is achieved, then it is a necessity to get the title deeds issue resolved.”

What an awful situation!!.This to me sounds like an evergrowing problem in Altinkum at this moment,we have in England seen on  2 national TV programmes one being GMTV  and another being Trisha,this type of problem with deeds for the Altinkum area,(even WITH the supposid help of solicitors). As these problems are arising with regularity.. surely the local council would be better to get involved as it WILL effect tourism ,which so many buisnesess rely on in the Altinkum area,

1.  Whose been paying council tax?

2.  Whose been paying water.

Can the council not back these people up if they have been paying them.


The estate agents get off easily.  Had they looked after their clients well and protected their money.  This wouldn't come into the equation.
They could have notarised contract, put Ipotek on tapu etc.

we are one of the people about to lose our apt within this block,but are using a different solicitor to fight our case without much joy to date.We have been paying electric.as not having had the deeds were not liable to to date for council tax utility. In hind site i would imagine this is one of the bills the builder is in prison for ! What the article also failed to mention is that despite buying through a reputable estate agent semih,who runs the altinerson hotel and what used to be the sur resturant,we were advised to use one mutlu gengiz(probably spelt wrong) as our solicitor by semih,only for this solicitor to run off with all our fees for army searches and taxes,this happened to everyone who bought their property via bluesea on this complex.it was later discovered that the said solicitor was actually a close relative of the builder so they were both in effect committing the crime.Mutlu no longer practises as a solicitor and was taken to court on other charges of fraud. After this we had to employ a new solicitor and pay out all the charges yet again.You must be thinking what stupid people we all are but i can asure you we are all well educated and professional people, and our only crime in this is trusting others that are so say professionals and turkish. What can we do except watch our childrens inheritence be sold from under our feet!! There doesnt seem any solution within the turkish law,that sends a man to prison for abounced cheque for a meagre sum,but lets him get away with stealing properties worth £200000!+ WITHOUT PROSECUTION ! where is the justice in this country.

Good luck to those involved.  I hope as they have found out about these problems before their properties are auctioned they will be able to secure their investments and obtain their tapu's. 

Honest buyers should not have to fight for what they have paid for in good faith.

I still believe it is ethically wrong that properties bought and paid for are being seized to recoup builders/landowners debts.

The Turkish government must take some responsibility for the appalling state of sales to foreigners that are caught up in these scandals - many due to the long process of obtaining military clearance.  This process has left a loophole from which most of these cases have stemmed during the period of 2005 -2008.

Those of us unfortunates that are now trying to obtain recompense are paying dearly for those oversights.
