Foreign investors stake their claim

A GROUP of British families has ‘seized’ a Didim housing complex in a landmark ruling in Turkey as they battle to secure their title deeds.
The court ruling, focused on the Golden Beach Complex, at Imbat, could now open the floodgates for other foreign investors across Turkey in their bid to get title deeds on the properties they own.
Last Friday, a judge at Didim Civil Court granted a temporary injunction on behalf of 41 families to ‘freeze’ the land on which the Didim Design Group complex is built on from being transferred to a third party by landowner Ahmet Akyel.
Lawyer Burcu Orhan, who is representing the families, was forced into issuing the injunction after lengthy amicable attempts to get the title deeds secured from Akyel failed.
The 41 families have spent between £50,000 and £75,000 – an estimated total of about £2.5 million - on apartments on the complex which was finished by Didim Design Group 18 months ago.
Ms Orhan, an attorney in law and founding partner of London Legal International, representing the families, said some families had been waiting in excess of two years for their title deeds. |  |
She said: “I began representing these families about a year ago and despite all efforts to negotiate with the landowner for their title deeds in an amicable manner, the discussions failed.
“The contracts the investors signed with the developer between 2006 and 2007 would not officially protect them under Turkish law and there was a very high likelihood that they would be left with nothing, such as homes and life-savings, if the potential threat of the transfer of the land to a third party was carried through.
“After negotiations stalled with the landowner and having considered our position, we were forced to obtain a temporary injunction on the families’ behalf which essentially freezes the land from being passed to a third party.”
She added: “In doing so, we are simply protecting our clients’ investment and will now help all sides focus on securing the title deeds for the families we represent.
“If we hadn’t acted, it would have put our clients in a very vulnerable position in pursuing their title deeds. I very much hope that this injunction will now lead to the landowner issuing the deeds.”
The resumption of the court case is scheduled for January 4, 2010.

At last the truth will come out. I have been banging on about this injustice on Golden Beach Complex for over twelve months. Only to be told to shut up and called all sorts of names and have lies told about me . I gave details to Voices Newspaper on October 29/2008 expressing my concerns about being ripped off. I reported this scandal to the Jandarma. I have posted on numerous websites warning about this Scandal and have been barred by many website owners for telling the truth. Well done to Solicitor Burcu Orhan from London Legal International Solicitors for having the guts to stand and put the truth forward.The truth is about to come out about this Complex.

It must be doing a lot of good as I saw him in yet another mobile phone shop in Gumbet !!!
Perhaps Ms Orhan would be a better solicitor than the one they have now !

So many people have taken cases and got nowhere because of the loopholes in Turkish law that are continually abused in favour of Turkish agents, builders and Landowners. It makes one wonder why it has taken a London based lawyer to make headway, when so many Didim based lawyers seem to accept payment for cases and achieve so little in comparison. If Didim’s lawyers had taken similar action these fraudulent practices would have been stopped in their tracks. Banks wouldn’t have been able to sell on properties that had been paid for in full, furnished and lived in, and those withholding tapu’s for their own financial gain would not have been able to raise money on property/land that they had already sold. The more people that speak out will eventually make the government realise how big this problem is, and that people are not going to stand back and let it happen.
By using platforms such as Voices Newspaper, forums and the Internet those affected by Turkish property scams are highlighting their plight, making purchasers question their own circumstances and hopefully stopping anyone else finding themselves in a similar situation.

They are next door to each other - and thankyou Esther for having the guts to stand up and tell the truth just a pity others dont do the same. Then perhaps we would all get our money back or at least justice would be done.

Here is another good example of what is happening to the buyers that haven't recieved their tapu's.lf you haven't recieved your tapu's as promised,then check it out as to why you haven't been given the legal document and then take the appropiate action immediately. |
