Golden showdown

THE complicated case of Golden Beach Complex is set to resume at Didim court on March 29, Voices has learned.

Burcu Orhan, Attorney at Law and founding partner of London Legal International, is representing a majority of home owners on the complex in a legal tangle with the land owner Ahmet Akyel over the land and dealings with builder Didim Design Group.

In a resumed hearing on January 4, Didim Court declined Ahmet Akyel’s lawyer’s objection for the case to be separated into 41 individual cases.

Last October, as part of the ongoing court case, Miss Orhan was granted a temporary injunction on behalf of her clients to ‘freeze’ the land on which the Didim Design Group complex is built on from being transferred to a third party by Akyel.

In order for the injunction to remain, the court in January also decided on a 5% security payment to be deposited to the court’s account since Turkish laws state this and the security payment could be anything between 5% to 20% of the claimed amount.

Miss Orhan said: “We are very glad the court kept it at 5%. Even the 5% makes app £52,000 since the overall claimed amount is very high and our clients struggled to pay this.

“The clients received tremendous support from other owners who are not a part of the case to keep the injunction in order and within a week the whole amount was deposited in our client account then to the court’s account. 

“People who did not go to court or cannot afford to go to court paid monies to keep the injunction in place with the current clients so that Akyel doesn’t transfer the land into any third parties’ name for which there were rumours about.

“The whole process has shown me the power of community and people sticking together to get justice. It was quite moving.”

This is against a backdrop of a winter of discontent for residents there as electricity and water have been switched off, a transformer taken away by bailiffs, and a new one being installed after residents scrambled to finance the move and remain on site with facilities.

Is the Mr Ahmet Akyel mentioned in this article the same Mr Akyel that is involved in the 'Irish scam' involving Mr Kevin O'Kane?  Perhaps someone could enlighten me please.

Hope this time the rightful owners will get justice in the Didim court, although i wouldn't hold my breath.  No doubt they will come up with some other delaying tactic, just as they did with other cases.

This is a well worked scam in this area. This person Ahmet Akyel portrays himself as a well meaning honourable individual, in fact, he is anything but. He has his filthy hands all over this scam and the Golden Beach Villas. The Turkish government are very aware of this scandal and refuse to do anything about it. This needs maximum press attention in the UK. Write to you MP’e and MEP’S!! Turkey can never become part of the EU, until they clean up their act. Many buyers have already been in touch to give their details of buying in Turkey.
She insists she will report on all scandals like this one.
Rebecca advised all others to get in touch with their situations/experience's of buying property/land here in Turkey.

Its the same company that looked into Beckie and Taffs Tapu Scandal.

I have received an enormous number of letters and emails from people who have encountered problems when trying to buy property abroad. Initially these were concentrated in Spain , but increasingly I am also being contacted by people with properties in Bulgaria and Turkey .
Ultimately these are matters that must be resolved by the national courts but as your experience shows, the judicial process can be slow and unreliable.
In the past when I have written to the European Commission regarding unscrupulous developers in Turkey they have replied in the following way:
"The European Commission does not interfere with ongoing judicial processes. However, the Commission will follow these cases closely and expects that the Turkish justice will address them properly.
In the context of accession negotiations the Commission will encourage Turkey to address property fraud issues in an effort to ensure that the rights of EU citizens who legitimately purchase property in the country are appropriately safeguarded."
Since receiving this response a new Enlargement Commissioner, Stefan Fule, has been appointed. I will write to remind him of the problems people like you have faced in Turkey and urge him to continue to encourage Turkey to address property fraud issues during the course of the country’s accession negotiations.
I will also write to Foreign Office Minister Ivan Lewis and be sure to contact you with details of his in due course.

THE CHANGE IN TURKEY MUST HAPPEN NOW!!

Can anyone look for justice in Turkey while this is allowed to go on .I am just someone who has been affected by the Tapu scams by unscrupulous landowners in Turkey.

Firstly: How can a landowner sell his land (be it through allocated properties or monetary) and still have the right to hold the freehold to this land when the land has been passed as construction land? Then hold the property purchaser and construction company to ransom and in some circumstances sell the said land on again to a third party? This practise must stop and changes must be made.

Secondly: When the land has been approved as construction land by the powers that be, that land must change into building land and the landowner should not own the freehold to that land as he or she in affect has sold it with the land deal.

Thirdly: This land should be held and recorded at the land registry, When construction is finished and all relevent  papers are issued the land registry then should issue the tapus to the property buyers as and when each section is sold and registered.

Finally; Any landowner or construction company found to be guilty of fraudulent practises should lose his land or business to compensate their victims.  This would soon stop the scams. Justice must be seen to have been done by the courts, then maybe foreign investors would have confidence in purchasing property in Turkey.

I am an Owner of a villa on the Golden Beach Villas complex, which is adjacent to Golden Beach Complex. 

I write now to put some balance into the discussion.

I have written before in Voices comments concerning Mr Akyel's involvement in the Irish Scam of 2006.

I have given a signed statement to the N.I. Fraud Squad concerning this matter, as my villa was one of those "resold" by the perpetrators. The case is still in progess.

Although I am not happy about everything on our Complex, I have no reason to believe Mr Akyel took any part in the Scam. The language barrier was a major reason why the culprits were able to pull it off right under his nose. 

At Golden Beach Villas Complex, we all have our interim Tapu Irtifaki, and our Habitation Certificates have been registered at the Belediye. He has delivered what he promised.

Mr Akyel sold the land on which the Golden Beach Complex was built to the developers, but has not been fully paid for it. It was not his development, and as a businessman, he  now wants his money.

I agree that Mr Akyel could be more compassionate over this matter with the Owners at Golden Beach Complex, and I can say that you that you do have the sympathies of all Owners at the Villas. We are watching the outcome of this matter with great interest, and if there is anything members of our group can do to assist, there is already a channel of communication that your members can use to contact us.

I, and the other Owners at Golden Beach Villas Complex have been very lucky with our purchase in Turkey. I would not advise anyone to take a chance until Turkish laws are changed to protect the buyer. Until then, do not part with a penny, unless you are able to accompany the builder to the Council Offices, and see your Tapu issued and stamped in your name!!
