Academic wins lawsuit for 60 lira overcharged internet fee

An academic living in Aydın was successful in a lawsuit filed against a company for a 60 lira internet fee he claimed to have been taken in violation of the contract.

Aydın Adnan Menderes University (ADU) Faculty of Communication Lecturer Assoc. Prof. Dr. Ali Emre Dingin became an internet subscriber to a company for an annual commitment and 99.90 liras per month.

According to Dingin’s claim, after the first month of the contract, the company invoiced 60.37 liras over the price notified to him. Upon this, Dingin, who wanted to terminate his subscription, sent a notice to the company via the website and in writing from the notary public.

The academician, who could not find a response from the company, took the matter to the Efeler Consumer Arbitration Committee.

Dingin demanded the termination of his subscription, the refund of the excess money he paid and the notary expenses required for the notice.

The committee, which evaluated the application, gave a negative answer on the grounds that the company had an execution proceeding against Dingin. This time, Dingin took the matter to Aydın 4th Civil Court of First Instance.

Accepting the objection, the court ruled in favour of Dingin, ruling that “it is not possible to make a new price change in accordance with the provisions of the contract”.

As a result of the decision, the cancellation of the contract requested by the applicant was carried out and 60 lira and notary expenses were returned.

Making a statement to AA correspondent, Dingin said that he started the subscription cancellation process after the amount notified to him for internet use increased every month, but since he could not get a result, he sought his rights through legal means.

Pointing out that subscription contracts must be read, Dingin said, “They put such clauses in the contract that they do not terminate their subscriptions without paying a certain amount, and if people think that there is an unfair payment or a high bill like me, they should definitely seek their rights through legal means.

“The amount may seem small, but the important thing is to be able to say ‘stop’ to unjustly received fees. I wanted to be an example to consumers, I won the lawsuit I filed for the refund of the excess fee I paid and all expenses in the legal process.”
